*TRANSFER AGREEMENT*

1- Parties

The service provider will be referred to as the "Agency," acting as Hazarfen Tasimacilik Turizm Seyahat ve Tic. Ltd. Sti. The individual(s) whose name and surname are specified in the reservation and/or those they represent will be referred to as the "Consumer."

 

2- Subject

This contract is entered into between the Consumer and the Agency. It covers services sold by the Agency, specifying the characteristics and terms of sale of services provided in written, visual, telephone, and electronic formats. It encompasses reservations made by the Consumer on the Agency's website for transfer, tour, and vehicle allocation services. The characteristics of the purchased service are detailed in the Distance Sales Agreement and on the "Terms and Conditions" pages on the Agency's website, as well as in the reservation and confirmation form sent to the email address.

 

3- Duration of the Contract

This contract comes into effect on the date the reservation is confirmed by the Agency and automatically terminates upon completion of the service provided by the Consumer, provided there is no dispute. In case of a dispute, the contract remains valid until the dispute is conclusively resolved.

 

4- Payment and Invoice Information

When purchasing a service with a credit card, the Consumer is obliged to pay the service fee at the time of booking. The service fee includes VAT. Reservation and payment imply acceptance of the provisions stated in the Distance Sales Agreement and on the "Terms and Conditions" pages on the Agency's website. Complaints and refund requests must be submitted to info@bizimtransfer.com within 14 days from the date of service. The invoice issuance period for the purchased service is 7 days, excluding the purchase date, in accordance with the Tax Procedure Law. The Agency will use the information provided in the reservation form for invoicing. Additional fees determined by the bank or payment systems for credit card installment payments will be added to the service fee. Any expenses arising from the cancellation and refund of credit card payments will be deducted from the refund amount at the customer's expense.

 

On our website, for prepaid cars in some destinations, only prepayment may be available as a payment option. In airport arrival transfers, the waiting time at the airport is set as a company policy for 90 minutes. Deductions for commissions from international bank transfers are the responsibility of the sender. To avoid issues, confirmation should be obtained from your bank.

 

5- Cancellation and Changes

If the Consumer requests cancellation up to 12 hours before the start of the service, the entire service fee paid will be refunded. If the Consumer cancels within less than 12 hours, 50% of the one-way service fee will be refunded (full return fee if the return fee has been paid). If information provided by the Consumer in the reservation is found to be incorrect, the Agency may cancel the reservation. The Agency may also contact the Consumer in advance for confirmation regarding the reservation. Due to operational reasons, the adjustment of schedule is entirely within the purview of the company. Non-response to calls or emails may result in the cancellation of the reservation. These conditions do not apply to promotional services, early bookings, or discounted reservations. Cancellation provisions apply to date changes made by the Consumer. The Consumer agrees to comply with the rules of the service agreement, respect the safety and well-being of third parties; otherwise, the Consumer acknowledges that they may not rightfully receive the service and that there is no right to a refund. In case of unauthorized use of the Consumer's credit card by unauthorized persons for reasons not caused by the Agency's fault and the bank or financial institution associated with it does not pay the service fee, the Consumer is responsible for the service fee and any losses resulting from it.

 

6- General Provisions

If the Agency becomes aware that there may be a hindrance to the transfer due to mechanical failure, traffic accidents, operational disruptions, adverse weather conditions, traffic congestion, terrorist incidents, law enforcement actions, etc., the Agency will attempt to provide an alternative vehicle as soon as possible and/or inform the Consumer. Transfer vehicles may arrive at the pick-up point 10 minutes before or after the specified time. Passengers must be at the pick-up point 10 minutes before the notified time. If the vehicle does not arrive, passengers must wait at the pick-up point for 10 minutes. If the vehicle is delayed by more than 15 minutes, the agency must contact the transportation company, obtain confirmation, and then provide means for the passenger to arrive independently. These times are specified in the transportation company's schedule.

 

Transfer vehicles at the airport may wait for passengers for up to 90 minutes. In case of delayed arrival of the vehicle to the passenger pick-up point due to force majeure (accident, breakdown, tire burst, traffic conditions, etc.), the waiting time can be up to 1.5 hours. In the situations mentioned above, the transfer fee already paid will be refunded to you without any deductions, and/or in such a case, the price difference due to the Consumer's transportation to the airport at their own expense will be paid by the Agency. The price difference does not cover the plane ticket.

 

7- Effect

This agreement consists of 7 main articles and, if necessary, will be drawn up in 2 copies and signed by the parties. In case of disputes arising from this agreement, the provisions of Law No. 4925 on Road Transport will be applied. Alanya courts and enforcement offices are authorized to resolve disputes arising from this agreement. I declare that I have read and accepted all the provisions of the Transfer Sözleşmesi, as stated on the terms page of the Agency's website, on behalf of myself and/or the names specified in the booking form. This statement is valid even if the booking procedure is carried out and/or signed by someone else. As a Consumer, I confirm responsibility for the accuracy of the information in my booking, accept the provisions of Law No. 4925 on Road Transport, and understand and accept the information on the Agency's website.
